The Lasting Power of Attorney is one of the most talked about planning tools in Singapore, and one of the most misunderstood. Here are the questions we hear most often, answered plainly.
No. An LPA only comes into effect when you have been formally assessed to have lost mental capacity, typically through an assessment by a registered medical practitioner. Until that point, your donee has no authority to act on your behalf. You remain fully in control of your own affairs for as long as you are mentally capable.
A joint account means your spouse can access those shared funds, yes. But it does not give them the authority to make medical decisions on your behalf, manage sole-owned property, deal with CPF matters, or decide your living arrangements. An LPA covers a much broader scope than any bank account arrangement.
This is one of the most common assumptions — and one of the most costly. Without an LPA, your spouse has no legal authority to manage your individual assets or make welfare decisions on your behalf, regardless of how long you have been married. They would need to go through the deputyship process, which is lengthy, expensive, and emotionally draining for everyone involved.
A Will only takes effect after you pass away. It says nothing about what should happen if you are alive but mentally incapacitated. The LPA fills that gap. It is the document that speaks for you while you are still here.
